The company behind an $8.9 billion carbon-capture pipeline proposed for five Midwestern states says it wants to indefinitely delay its plans after South Dakota passed a law limiting its ability to acquire land for the project.

South Dakota Governor Larry Rhoden signed a bill on Thursday banning the use of eminent domain, which allows private land to be taken for public use, for the construction of carbon dioxide pipelines,

The legislation would prohibit carbon pipeline companies from acquiring land by eminent domain. That’s the right to access private property for projects that benefit the public, with just compensation determined by a court. Eminent domain is commonly used for projects such as electrical power lines, water pipelines, oil pipelines and highways.
